Fresh1204 Co. is an online retail business specializing in food, apparel, personal care products, everyday essentials, and other consumer goods, including products intended for institutional and compliance-based ordering where applicable.
By accessing or using Fresh1204.com, you agree to these Terms & Conditions and all applicable laws and regulations.
2. Products & Availability
All products are subject to availability. Fresh1204 Co. reserves the right to update or discontinue products, modify product descriptions or pricing, and limit quantities when necessary.
We make reasonable efforts to provide accurate product descriptions, images, prices, weights, and availability. If an error is discovered, we reserve the right to correct it before or after an order is placed.
3. Orders & Acceptance
Submitting an order does not guarantee acceptance. Fresh1204 Co. may verify order information or cancel, refuse, or limit an order because of product availability, payment issues, institutional requirements, shipping restrictions, or other legitimate business reasons.
If Fresh1204 Co. cancels an order after payment has been received, any applicable refund will be processed according to our Refund & Return Policy.
4. Institutional & Correctional Facility Orders
Certain products may be purchased for delivery to correctional facilities or other institutional environments.
Customers are responsible for providing accurate recipient and facility information and reviewing applicable institutional requirements before ordering.
Institutional orders remain subject to receiving-facility rules, carrier requirements, applicable laws, security procedures, and package acceptance policies.
Products described as Directive 4911 compliant are selected or prepared with applicable NYS DOCCS Directive 4911 requirements in mind. This description does not constitute an endorsement or guarantee of acceptance by NYS DOCCS or any individual correctional facility.
Fresh1204 Co. cannot guarantee that a third-party institution will accept a particular package or product.
5. Pricing & Payments
All prices are displayed in U.S. dollars unless otherwise stated.
Payment must be completed using an accepted payment method at checkout. Fresh1204 Co. reserves the right to correct pricing or listing errors and cancel orders affected by material errors.
6. Shipping & Delivery
Processing times, shipping charges, delivery estimates, available carriers, and other shipping conditions are described in our Shipping Policy.
Delivery dates are estimates and are not guaranteed. Delivery may be affected by carrier delays, weather, address issues, institutional processing, security procedures, or other circumstances outside Fresh1204 Co.'s reasonable control.
7. Returns, Exchanges & Refunds
Returns, exchanges, and refunds are governed by our Refund & Return Policy.
Eligible non-perishable products may be returned within 10 days of delivery when they are unused, in their original condition, and returned in their original packaging.
Perishable products are non-returnable and non-refundable except where otherwise required by law or where Fresh1204 Co. determines that an order qualifies for a refund because of an incorrect item, damaged or defective product, or processing or fulfillment error.
Eligible non-perishable products may also be exchanged within 10 days of delivery, subject to product availability and the conditions stated in our Refund & Return Policy.
Unless the return resulted from an error by Fresh1204 Co., customers are responsible for applicable return shipping costs.
Approved refunds will be processed within 5 business days after the returned product is received and inspected. The time required for the refund to appear on the customer's original payment method may vary depending on the bank or payment provider.
8. Institutional Rejections
Fresh1204 Co. is not responsible for packages refused or rejected because of facility-specific restrictions, recipient eligibility, institutional processing procedures, or inaccurate information supplied by the customer.
Customers should verify applicable facility requirements before placing an institutional order.
9. Limitation of Liability
To the extent permitted by applicable law, Fresh1204 Co. is not responsible for indirect, incidental, special, or consequential damages arising from the use of our website, products, third-party carriers, or institutional processing.
Nothing in these Terms limits rights or remedies that cannot legally be excluded.
10. Customer Responsibilities
Customers agree to provide accurate and complete ordering, billing, shipping, recipient, and facility information; comply with applicable institutional requirements; and use Fresh1204.com only for lawful purposes.
11. Third-Party Services
Fresh1204 Co. may use third-party payment processors, shipping carriers, technology providers, and other service providers to operate our business.
Those third parties may maintain their own terms and policies.
12. Intellectual Property
Fresh1204 Co.'s original website content, branding, logos, graphics, product designs, and other proprietary materials may not be copied, reproduced, distributed, or commercially used without authorization, except where otherwise permitted by law.
Third-party trademarks and product names remain the property of their respective owners.
